1. Agreement to Terms
These Terms of Service (“Terms”) are a binding agreement between you and Cajun Ink Designs, LLC (“we,” “us,” or “our”), a Louisiana limited liability company operating thekrewelings.com (the “Site”) and selling The Krewelings™ product line. By using the Site, subscribing to our newsletter, or purchasing our products, you agree to these Terms.
If you do not agree, please do not use the Site or purchase our products.
2. Eligibility
You must be at least 18 years old to make purchases on this Site or enter into these Terms. By making a purchase, you represent and agree that you are 18 or older and have the legal capacity to enter into a binding contract. Purchases or attempted purchases by individuals under the age of 18 are not authorized and are not enforceable contracts.
3. Our Products
The Krewelings is a social-emotional learning (“SEL”) product line including emotion-based card decks, teacher’s workbooks, classroom posters, and related materials featuring 20 original animal characters. Products are sold for personal, classroom, and therapeutic use as described in their respective product listings.
4. Intellectual Property
All content on the Site — including but not limited to the names, likenesses, and designs of all 20 Krewelings characters (including but not limited to Hux, Tavi, Emo, Pebb, Cubby, Mirren, Gimble, Flicker, Rizzo, Fayne, Kip, Ziggy, Chili, Lexi, Sage, Gumbo, Boplin, Taz, Patch, and Pali), the Krewelings wordmark and logos, illustrations, text, photographs, layouts, and the overall “look and feel” of the brand — is owned by Cajun Ink Designs, LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may:
Use products you purchase for personal, classroom, or therapeutic settings as described
Quote brief excerpts of our text content with attribution for review, news reporting, or academic purposes (fair use)
You may not:
Reproduce, copy, scan, photograph for redistribution, photocopy, or otherwise duplicate our products or any portion of them for distribution, resale, or sharing with third parties
Create derivative works based on our characters, designs, or text
Use our characters or branding in your own products, services, or marketing
Remove, alter, or obscure copyright, trademark, or proprietary notices on our products
Use our materials in any AI training dataset
The Krewelings™ is a pending trademark of Cajun Ink Designs, LLC.
5. Orders and Pricing
Pricing: All prices are listed in U.S. dollars and are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout. We make every effort to ensure that the prices and information on our Site are accurate. However, in the event of a typographical or pricing error, Cajun Ink Designs, LLC reserves the right to refuse or cancel any orders placed for products listed at the incorrect price.
Order acceptance: Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud. If we decline your order, we will refund any payment received.
Sales tax: We collect applicable sales tax on all orders shipped to states where we are required to do so.
6. Shipping
We ship exclusively within the United States. Shipping times and costs are calculated at checkout. Risk of loss transfers to you when we deliver your order to the shipping carrier. We are not responsible for delays caused by the carrier, customs, weather, or other circumstances outside our control.
7. Returns and Refunds
Damaged or defective items only. We accept returns, replacements, or refunds only for items that have a manufacturing defect or that were damaged before or during delivery. For purposes of this policy, a “damaged or defective” item means:
a printing or production defect — for example, misprints, missing or blank pages, binding or spiral defects, mis-cut cards, or incorrect color;
an item that arrived damaged in transit — for example, crushed, torn, or water-damaged on arrival; or
the wrong item or quantity shipped.
This does not include damage or wear that occurs after delivery — including spills, stains, marks, writing, tearing, bending, normal use, mishandling, or any damage caused by the customer — nor does it include change of mind, ordering errors on your part, or items used and no longer wanted. Because our products are printed educational materials, they are difficult to verify as unused once received.
To request a replacement or refund, contact us at returns@thekrewelings.com within 14 days of receipt with your order number and clear photographs showing the defect or damage. We review each request and, at our reasonable discretion, will replace the item or issue a refund for qualifying claims. Because we verify by photograph, we generally do not require you to return the item; if we do request a return for a qualifying claim, we cover the cost of return shipping and the shipping cost of any replacement we send. We may decline requests where the photographs indicate the damage occurred after delivery or is otherwise inconsistent with a manufacturing or transit defect.
8. Newsletter and Email Communications
If you subscribe to our newsletter, we will send you periodic emails about new products, educational content, and occasional subscriber-only resources. You can unsubscribe at any time using the link in any email we send.
9. User Content
If you contact us, leave comments, or otherwise submit content to us (other than personal information governed by our Privacy Policy), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business. You represent that the content is yours to submit and does not infringe anyone else’s rights.
We may use customer feedback, testimonials, and reviews in our marketing materials. If you do not want a specific message or review used publicly, tell us when you submit it.
10. Prohibited Uses
You agree not to:
Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any portion of the Site
Interfere with the operation of the Site (denial-of-service attacks, scraping, etc.)
Use automated systems (bots, crawlers) without our written permission, except for legitimate search engine indexing
Impersonate any person or entity
Use the Site in any manner that could disable, overburden, damage, or impair it
11. Disclaimers
Educational purpose: The Krewelings products are educational materials designed to support children’s social-emotional development. They are not medical devices, psychological treatment, or substitutes for professional mental health care, medical advice, or therapy. If a child shows signs of serious emotional, behavioral, or mental health concerns, please consult a qualified mental health professional.
Site availability: The Site is provided “as is” and “as available.” We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
No guarantees of outcomes: While our products are based on the CASEL framework and grounded in social-emotional learning best practices, we make no guarantees about specific outcomes for individual children.
12. Limitation of Liability
To the maximum extent permitted by law, Cajun Ink Designs, LLC and its officers, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or our products.
Our total liability for any claim arising out of or relating to these Terms or our products will not exceed the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.
Some jurisdictions do not allow exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Cajun Ink Designs, LLC and its officers, members, employees, and affiliates from any and all claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site or our products, or your violation of any applicable law or third-party right.
14. Governing Law, Mediation, and Disputes
These Terms are governed exclusively by the laws of the State of Louisiana, without regard to its conflict of laws principles.
Any and all legal actions involving any dispute arising under these Terms and/or arising out of the purchase of our products shall be filed exclusively in the state or federal courts of Louisiana located in Orleans Parish, Louisiana. Through use of this Site and/or the purchase of our products, you hereby consent to the exclusive jurisdiction of those courts and the exclusive application of Louisiana law.
Pre-suit mediation. In the event of any dispute between the parties, they shall first attempt to resolve it through informal mediation before filing any legal action. The mediation shall be held before a neutral attorney or mediator with at least ten (10) years of business experience, or a retired judge (a “Qualified Mediator”). Within ten (10) days of a demand for mediation, the parties shall attempt to agree on a Qualified Mediator; if they cannot agree, each party shall select a Qualified Mediator, and those two shall select a third neutral Qualified Mediator to conduct the mediation. Subject to the mediator’s availability, the parties will make best efforts to hold the mediation within fifteen (15) days of the demand, and shall split the mediator’s fees and costs equally. Any party who fails to participate in the mediation waives that party’s right to recover attorney’s fees in any subsequent action. If the dispute is not resolved through mediation, it shall be filed and resolved exclusively in the courts identified above.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by updating the “Last updated” date and, for significant changes, by email to active subscribers or customers. Your continued use of the Site or purchase of products after changes are posted constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
